DMCA Policy

1. Copyright Policy

Conservatist respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to claims of copyright infringement on our website.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this site, you may notify our copyright agent as set forth below.

2. DMCA Notice Requirements

To file a DMCA notice with us, you must provide a written communication that includes the following:

  • A physical or electronic signature of the copyright owner or person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
  • Your contact information, including your address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

4. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us. A counter-notification must include:

  • Your physical or electronic signature
  • Identification of the content that has been removed or disabled and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which we may be found
  • A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Conservatist has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others.

6. Processing Time

We will review all properly submitted DMCA notices and take appropriate action within a reasonable timeframe. Please allow up to 5-7 business days for us to process your request.

7. Fair Use

Before submitting a DMCA notice, please consider whether the use of copyrighted material falls under fair use. Fair use is a legal doctrine that permits limited use of copyrighted material without permission from the copyright holder for purposes such as criticism, comment, news reporting, teaching, scholarship, or research.

8. False Claims

Please be aware that if you knowingly misrepresent that material or activity is infringing, you may be liable for damages, including costs and attorneys' fees, incurred by us or the alleged infringer.
